Vancouver Island Health Authority ("Island Health") is pleased to host its premier health Hackathon, “Code Hack” on the campus of the Royal Jubilee Hospital on March 7, 8 and 9, 2025.​

Code Hack is an opportunity to work creatively in teams on health care challenges and themes with the assistance of mentors from Island Health, academic institutions, as well as local companies and entrepreneurs. Participants will have the opportunity to create and submit works (each submitted work an “Entry”) that have the potential to provide solutions relevant to Island Health and the health care industry in general.

Code Hack is governed by this Island Health Event Agreement (the “Agreement”). By participating in Code Hack, you (“you” or the “Participant”) agree to be bound by the terms of this Agreement, the decisions of Island Health (and its Code Hack judges) in relation to Code Hack, and all applicable laws.

1 PARTICIPATION

1.1 Eligibility:​

Code Hack is open to all legal residents of Canada. Participants must sign this Agreement, and those Participants not of legal age of majority in British Columbia (19 years) must also have this Agreement signed by a parent or legal guardian. Participants must not be subject to contractual limitations or employment conditions which restrict their ability to fully participate in Code Hack or license the intellectual property rights in their Entry as contemplated in this Agreement.​

Island Health reserves the right to require proof of identity and/or eligibility from Participants in a form acceptable to Island Health. Failure to provide such proof to the satisfaction of Island Health in a timely manner may result in disqualification.​

1.2 Registration: 

Applications for registration will be available from January 12, 9:00 PST until February 9 at 23:59 PST (the “Application Period”).

Individuals who wish to participate must apply for Code Hack during the Application Period at islandhealth.ca/codehack. Island Health will send a confirmation email to each applicant.​

Applicants will be notified between February 9, 2025, and February 24, 2025, if their application is successful. There is no registration fee for Code Hack.​

Code Hack begins on Friday, March 7, 2025, at 17:00 PST and ends on Sunday, March 9, 2025, at 14:00 PST (the “Code Hack Period”). The event will be held at Royal Jubilee Hospital Campus (1952 Bay Street, Victoria, BC).​​

Registered Participants must be present in person to sign in to Code Hack no later than Saturday, March 8, 2025, or they may be disqualified.​

1.3 Expenses:

Participants are responsible for their own transportation to the Code Hack venue and all other personal costs/expenses for the duration of the Code Hack Period.​​

2 INTELLECTUAL PROPERTY​​

2.1 Intellectual Property Rights

Intellectual property rights in each Entry will remain the property of the Participant(s) who create it, but Participants will license the Entry to Island Health on the terms set out below. Island Health accepts no responsibility for resolving intellectual property disputes among Participants.​​

Any intellectual property produced jointly may, subject to the agreement of the parties, be jointly owned and jointly copyrighted on terms acceptable to the parties. Joint ownership shall default to the following formula unless otherwise agreed:

• 50% – Island Health

• 50% – Participant(s)​

2.2 Grant of License

Any intellectual property arising from Code Hack conceived solely by the Participant shall be owned and managed by that Participant. That Participant shall grant to Island Health a non-exclusive, no-cost, royalty-free, transferable, sub-licenseable, perpetual, irrevocable license (the “License”) to use the intellectual property for their own internal research, clinical, and educational non-commercial purposes.​​

You agree to execute all further documents that Island Health deems necessary to perfect the License or confirm the intent of this Agreement. You agree that you will not, directly or indirectly, challenge the validity of the License or participate in or support any action that disputes Island Health’s right to use the Entry in accordance with the terms of this Agreement.​​

3 REPRESENTATIONS AND WARRANTIES, INDEMNITY, LIMITATION OF LIABILITY​​

3.1 Representations and Warranties

You represent and warrant that:

• (a) you meet the eligibility requirements and will abide by the terms of this Agreement and the decisions of the judges.

• (b) your contribution to your Entry will be your own original work or that you have all necessary rights or licenses.

• (c) your contribution to your Entry will not infringe the intellectual property rights of any third party.

• (d) your Entry will fully comply with the terms of this Agreement.​​

3.2 Indemnity

You agree to indemnify and hold harmless Island Health, including its directors, officers, employees, agents, and independent contractors, against all actual or alleged claims, liabilities, costs, and damages.​​

3.3 Limitation of Liability

In no event will Island Health be liable for any direct, indirect, special, incidental, punitive, or consequential damages, including but not limited to:

• Your inability to submit an Entry, or the disqualification of your Entry.

• Loss of use, data, business, or profits.

• Technical issues such as problems with Wi-Fi or computer systems.

• Cancellation, suspension, or alteration of the event.

• Personal injury.​​

4 PRIVACY STATEMENT AND MEDIA CONSENT

4.1 Personal Information

By participating in Code Hack, you consent to Island Health collecting your personal information for registration, event administration, and communication about future events.​​

4.2 Media Consent

You acknowledge that your name, image, voice, statements, and biographical information may be recorded or collected during Code Hack. You consent to the use of such materials by Island Health, Code Hack sponsors, and media outlets for educational, promotional, and marketing purposes.​​

5 GENERAL

5.1 Changes to Code Hack

Island Health reserves the right to cancel, suspend, or alter Code Hack at any time if necessary.​​

5.2 Disqualification

Island Health may disqualify any Participant who breaches this Agreement.​​

5.3 Governing Law

This Agreement and Code Hack are governed by the laws of British Columbia and Canada.​​

5.4 Code of Conduct

Participants must uphold Island Health’s values of courage, aspire, respect, and empathy, ensuring a respectful and inclusive environment.​​
